• You warrant that you have the right to do so and that such Contributions do not violate any third-party rights.
• You grant us an irrevocable, worldwide, royalty-free license to use, store, process, and share your Contributions for any lawful purpose, without any obligation to compensate you.

6. CONTRIBUTION LICENSE

By submitting any suggestions or feedback regarding the Services, you grant us permission to use and share such feedback without any compensation. You retain ownership of your Contributions; however, you provide us with a non-exclusive license to use, reproduce, distribute, and display your Contributions in connection with our Services.

7. SERVICES MANAGEMENT

We reserve the right, but are not obligated, to:

• Monitor the Services for compliance with these Legal Terms.
• Take appropriate legal action against any user who violates these Legal Terms, including reporting to law enforcement authorities.
• Remove or disable any content or Contributions that are deemed burdensome, excessive, or in violation of these Legal Terms.

8. TERM AND TERMINATION

We cannot guarantee that the Services will be available at all times, and you agree that we are not liable for any interruptions, delays, or errors in the availability or functioning of the Services.

10. GOVERNING LAW

These Legal Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located within the United States for any disputes arising out of these Legal Terms or the Services.

11. DISPUTE RESOLUTION

Informal Negotiations:
Before initiating any formal dispute resolution, the Parties agree to engage in informal negotiations for at least 180 days after written notice of a dispute is provided by either party.

Binding Arbitration:
If informal negotiations fail, any dispute arising out of or in connection with these Legal Terms shall be resolved by binding arbitration in accordance with the rules of an appropriate arbitration institution. The arbitration shall be conducted on an individual basis and not as a class action. Specific details regarding the number of arbitrators, the location, the language, and the applicable law will be provided in the arbitration notice. Notwithstanding this, disputes related to intellectual property rights, claims of theft or privacy invasion, or requests for injunctive relief are not subject to arbitration and may be brought directly in court.

12. CORRECTIONS

While we strive for accuracy, errors, inaccuracies, or omissions in the Services’ content may occur. We reserve the right to correct any such issues and update the information on the Services at any time without prior notice.

WE DO NOT GUARANTEE THE ACCURACY OR COMPLETENESS OF THE CONTENT ON THE SERVICES, AND WE WILL NOT BE LIABLE FOR ANY ERRORS, DAMAGES, OR LOSSES ARISING FROM YOUR USE OF THE SERVICES.

IN NO EVENT SHALL FEARS101, OR ANY OF OUR OFFICERS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY, WHETHER IN CONTRACT, TORT, OR OTHERWISE, SHALL NOT EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICES.

15. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Fears101, its affiliates, officers, agents, and employees from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

• Your use of the Services;
• Your violation of these Legal Terms;
• Any infringement of any third-party rights by your Contributions; or
• Any harm caused by your actions or omissions in connection with the Services.
  We reserve the right, at your expense, to assume exclusive defense and control of any matter for which you are required to indemnify us.

16. USER DATA

We maintain data transmitted through the Services to ensure proper functioning and performance. Although we perform routine backups, you are solely responsible for all data you transmit through the Services. We assume no liability for any loss or corruption of such data.

17. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES

By using the Services, you consent to receive electronic communications from us. These communications, including agreements, notices, and other disclosures, satisfy any legal requirement that such communications be in writing. You agree to the use of electronic signatures and records in connection with the Services.
